Lasting Power of Attorney

A Lasting Power of Attorney (LPA) is one of the most important legal documents you can put in place. It gives someone you trust the legal authority to decide on your behalf if you lose the ability to do so — whether due to illness, injury or old age.

At Convey Us Legal, we help individuals and families across Birmingham and the West Midlands set up LPAs with clarity and confidence. Whether you need help with Property and Financial Affairs or Health and Welfare, our experienced team is here to make the process stress-free and straightforward.

What is a Lasting Power of Attorney?

An LPA is a legal document that allows you (the Donor) to appoint one or more trusted people (Attorneys) to act on your behalf if you cannot make decisions yourself.

There are two types of LPA:

  • Property and Financial Affairs LPA
Let’s have your attorneys manage your bank accounts, bills, property, and financial matters.
  • Health and Welfare LPA
Allows your attorneys to make decisions about medical care, daily routines, and life-sustaining treatment — but only if you lose capacity.

Why Set Up an LPA?

  • Stay in control by choosing who manages your affairs
  • Avoid court delays and costly Deputyship applications
  • Protect loved ones from tough legal battles
  • Plan ahead in case of dementia, accidents, or long-term illness

Our LPA Service Includes:

  • Free initial consultation
  • Drafting both types of LPA (if required)
  • Advice on choosing attorneys and certificate providers
  • Submitting to the Office of the Public Guardian (OPG)
  • Guidance on fees, exemptions, and timescales

Frequently asked questions

Do I need a solicitor to make an LPA?

No, but mistakes can lead to delays or rejection. A solicitor ensures everything is done properly and that you're fully informed.

Can I make an LPA if I’ve already lost mental capacity?

Unfortunately, no. Once capacity is lost, your family must apply to the Court of Protection — a more complex and expensive process.

How long does it take to register an LPA?

The OPG usually takes 8 to 10 weeks, but we handle all paperwork and keep you updated.

Can I have more than one attorney?

Yes — you can appoint multiple attorneys to act jointly, jointly and severally, or a combination.

What does it cost to register an LPA?

The OPG charges £82 per LPA, but fee reductions or exemptions may apply.
